Police departments in Lincoln and Omaha discuss potential immigration raids

Lincoln and Omaha, NE — On Tuesday, the Lincoln and Omaha police departments issued immigration-related statements, each stating that they would not participate in raids.

The Omaha Police Department and Mayor Jean Stothert issued a video statement stating that the department does not intend to participate in any immigration raids and is unaware of any planned raids.

“The best approach to police this matter, from our perspective, is for the Omaha Police Department to keep the immigration side of things from federal authorities,” Omaha Police Chief Todd Schmaderer said at a press conference. “They will be the ones to do immigration enforcement.”

Stothert added that citizens should not be afraid to call 911 when they need assistance.

“We don’t want anyone to be afraid if you are a victim of a crime or a witness of a crime,” according to her. “We want you to feel free to call 911, and the Omaha Police Department will help you and will not check your legal status.”

Lincoln Police Chief Michon Morrow stated in a press release that the department will continue to enforce city ordinances and state law on an equal basis, regardless of an individual’s immigration status.

The release stated that LPD is “committed to ensuring public safety for all who call Lincoln home.”

“We want to assure the community that filing a police report or accessing law enforcement services is not dependent on citizenship or immigration status and can be done so without fear,” Morrow told the crowd. “LPD services are available to anyone who requires assistance or wishes to report a crime. We are committed to ensuring that everyone who interacts with LPD officers feels safe and respects them.

Morrow also reminded community members that federal law enforcement is still responsible for immigration enforcement. The LPD is not responsible for arresting or transporting those detained for immigration violations.

“The Lincoln Police Department does not contact individuals to determine immigration status and does not have the authority to enforce immigration laws,” according to Morrow. “Similarly, LPD does not make inquiries regarding immigration status in the course of routine investigations, as outlined in the department’s policy on unlawful or improper bias in public safety.”

The Lancaster County Sheriff’s Office stated that, with few exceptions, local law enforcement has no authority to enforce immigration violations.

“Just as our Federal partners come to our assistance when needed, LSO will provide assistance if requested and will cooperate within the scope of our legal authority and responsibilities,” according to the statement.

The Justice Department also announced plans to direct federal prosecutors to conduct investigations into state or local officials who obstruct immigration enforcement efforts.
